These terms apply to every order placed on this website. Please read them before you order. If you are buying as a business, section 13 applies as well.
2. You must be 18 or over
We only sell alcohol to people aged 18 or over. By placing an order you confirm you are. We may ask for proof of age, and a signature from someone aged 18 or over is needed on delivery. We will not deliver to anyone who appears to be under 18 or who is intoxicated.
3. In bond and duty paid
Every wine is offered either in bond or duty paid, and the product page says which.
- In bond means the wine is held in a bonded warehouse (normally London City Bond, Burton Gateway) with UK duty and VAT not yet paid. Prices exclude duty and VAT. The wine stays in bond, in your name, until you ask for it to be delivered. Duty and VAT then become payable at the rates in force on the day it leaves bond, together with delivery.
- Duty paid means UK duty and VAT are included in the price and the wine can be delivered to you.
An order may contain in bond wine or duty paid wine, not both. If you want both, please place two orders.
Our Duty and VAT page explains how the figures are worked out.
4. Prices and availability
Prices are in pounds sterling. Duty paid prices include VAT at 20%. In bond prices exclude duty and VAT.
Most of our wine is sourced from other suppliers and from private cellars, and availability can change quickly. An order is an offer to buy. The contract is made when we email to confirm your order, not when you pay or when the website acknowledges it. If a wine turns out to be unavailable, or has been listed at an obviously wrong price, we will tell you as soon as we can and refund anything you have paid in full. We will not charge you a different price without your agreement.
5. Payment
Payment is taken when you order, through Shopify Payments or another method shown at checkout. We do not see or store your full card details.
6. Delivery
We deliver to addresses in the UK mainland. Delivery from bond is £20.00 to the UK mainland unless we tell you otherwise when we confirm the order. Other areas are quoted on request.
Delivery times are estimates. Stock held in bond normally reaches you within one to two weeks of your request, as the wine has to be released from the warehouse first. Wine bought before release (en primeur) arrives when the producer ships it, which can be one to two years after you order. We will keep you told of any delay. If we cannot deliver within 30 days of the date we agreed, or within 30 days of your order where no date was agreed, you may cancel and have a full refund.
7. Ownership and risk
Wine becomes yours when we have received payment in full. For in bond wine, it is then held in the warehouse in your name. For delivered wine, responsibility for it passes to you when it is delivered to you or to someone you have nominated.
8. Storage
Wine left in bond with us is stored at London City Bond, insured at replacement value and recorded in your name. Storage charges are as shown on our Services and Membership pages, or as agreed with you in writing. Nothing is payable in duty or VAT while wine stays in bond.
9. Changing your mind
If you are a consumer, the law usually gives you 14 days after delivery to cancel an online order without giving a reason. Tell us by email within that period, and send the wine back unopened, in its original condition and packaging, within 14 days of telling us. You pay the cost of sending it back unless the wine was faulty or not what you ordered. We will refund you within 14 days of receiving the wine back.
This right does not apply where the law excludes it, including:
- wine bought en primeur or otherwise before release, where the price was agreed when you ordered, delivery can only take place after 30 days, and the value depends on market movements we cannot control;
- wine that has been opened;
- wine that, at your request, has been transferred to you in bond and has not been delivered to you, where the transfer has been completed.
This does not affect section 10.
10. If something is wrong
Please check your delivery when it arrives and tell us within 7 days of any breakage, missing items or wine that is not what you ordered, with photographs if you can. Fine wine is a natural product; older wine can vary from bottle to bottle and a sediment is normal. If a wine is faulty, we will replace it or refund you. Nothing in these terms affects your legal rights as a consumer under the Consumer Rights Act 2015.
11. Selling your wine through us
If you ask us to sell wine for you, the commission and other terms are agreed with you in writing before anything is listed. These terms of sale do not cover that service.
12. Our responsibility to you
We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss that was not foreseeable, or for business losses where you are a consumer. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.
13. Business customers
If you buy for a business, sections 9 and 12 do not apply to you. Our total liability to a business customer for any order is limited to the price of that order. You confirm that you hold any licence or registration your business needs to buy and resell alcohol.
14. Your information
We use your information as set out in our Privacy Policy.
15. Changes to these terms
We may update these terms. The version on the website when you place an order is the one that applies to that order.
16. Law and disputes
These terms are governed by the law of England and Wales. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings there. If you have a complaint, please email andrew@vincowines.com first and we will try to put it right.
